Examples of nonpublic personal information which DMS may collect include, but may not be limited to:

  • Account balances;
  • ACH numbers;
  • Bank account numbers;
  • Credit card numbers;
  • Credit ratings;
  • Date and/or location of birth;
  • Driver’s license information;
  • Income history;
  • Payment history;
  • Social Security numbers;
  • Tax return information; and/or
  • Name, address, phone number

Examples of sources from which DMS may collect nonpublic personal information include, but may not be limited to:

  • Interviews and phone calls with you;
  • Letters or e-mails from you;
  • Tax returns or financial documents;
  • Bank details provided by you; and/or
  • Client assessment & client onboarding questionnaires.

Disclosure of Nonpublic Personal Client Information

DMS respects your privacy. For purposes of our business relationships with our clients, any nonpublic personal information acquired by DMS is disclosed only to employees of DMS who need to know such information to perform services for which the client has engaged the firm.

DMS may also share your nonpublic personal information with service providers who require access to fulfill services or functions related to our services. This disclosure will only occur under a contractual agreement that explicitly prohibits the service providers from disclosing or using nonpublic personal information for any purposes other than those for which it was provided. All DMS service providers meet or exceed our privacy and security protocols.

Other than what is stated above, DMS Management Solutions does not disclose nonpublic personal information, or any other information, to any outside party without specific client authorization, except:

  • To comply with a validly issued and enforceable subpoena or summons;
  • To respond as part of any actual or threatened legal proceedings or alternative dispute resolution, provided DMS discloses only the information necessary to file, pursue, or defend against the lawsuit and take reasonable precautions to ensure that the information disclosed does not become a matter of public record; or
  • As otherwise required or authorized by law.

Data Retention, Confidentiality, & Data Security

DMS retains your nonpublic personal information in accordance with the terms of our engagement letter with you.

DMS may periodically update this Privacy Policy to reflect changes in its practices, services, or applicable laws. DMS encourages clients and visitors to its website to check our home page for its most recently updated Privacy Policy. Your continued use of DMS’ services after any modifications to the Privacy Policy will constitute your acceptance of the updated terms.
